A man has moved to court to “privately prosecute” Machakos senator Johnstone Muthama over hate speech remarks made at a public rally last week.
Joseph Kithyaka wants the court to allow him sue Muthama since the Director of Public Prosecution has ‘failed to institute criminal proceedings against the senator’.
Kithyaka said unless action is taken, the politician will have abused freedom of speech.
DPP Keriako Tobiko had formed an inter-agency team to investigate Muthama’s remarks, alleging President Uhuru Kenyatta was shielding Devolution CS Anne Waiguru from a graft probe because of their friendship.
On Wednesday, NCIC withdrew its summons against Muthama saying it did not receive formal communication from the DPP over the team to probe the claims.
Dagoretti South MP Dennis Waweru who filed the complaint said Muthama portrayed Uhuru as a “careless President preoccupied with his alleged clandestine lover, CS Anne Waiguru”.
The case will be heard on October 2.
