The legislator was charged in May 2014 for allegedly saying that the terror attack which happened in Gikomba Market killing 15 was orchestrated by “Odhiambos” and not “Somalis”.

The alleged remarks were reportedly posted on his Facebook page.

Trial Magistrate Teresia Nyangena ruled that the prosecution failed to establish that the Facebook account belonged to the lawmaker.

According to the magistrate, the prosecution also failed to satisfy the court by illustrating the manner in which Kuria updated his status.
