Bensouda loses bid for private session at ICC

ICC Prosecutor Fatou Bensouda yesterday lost a bid to have the 27th prosecution witness give his entire testimony in private.

The judges ruled that there were aspects of the testimony that were key but should be in public as they do not reveal his identity.

“Part of the protection measures requested were that you (witness) were to testify entirely in private session. We rejected that request. We believe there should be parts of the testimony that you can give in public because there are some parts of the testimony that will not identify who you are,” Presiding Judge Chile Eboe-Osuji ruled.

The witness is said to be a victim of the 2007-08 post-election violence.

His statement was among those used to confirm the case against Deputy President William Ruto and journalist Joshua Sang.

The prosecution says the witness is key in proving that Sang and Ruto were part of a network responsible for the violence.

The prosecution also claims Ruto was the leader of this network and was responsible for the funding and mobilisation of attackers.

The witness has however over the last three years disowned some of his allegations against Ruto and Sang.

Prosecution lawyer Lucio Garcia examined the witness on the first day of his testimony recounting the events before the December 27, 2007 general election.
