Court of Appeal affirms Nandi Hills MP Alfred Keter’s winThe Court of Appeal has rescinded the decision of the High Court to nullify the election of Nandi Hills MP Alfred Keter.

Judges Erastus Githinji, Fatuma Sichale and Hannah Okwengu Wednesday ruled that Mr Keter was validly elected.

The court further ruled that the petitioner, Benard Kitur, did not prove claims that Mr Keter engaged in election malpractice by campaigning beyond the stipulated time.

On March 1, 2018, the High Court in Eldoret had found that Mr Keter’s win in the August 8, 2017 election was marred by malpractices and irregularities.

Justice George Kimondo said the election was not held in a free and fair environment.

The Independent Electoral and Boundaries Commission declared Mr Keter the winner with 28,923 votes against Kitur’s 13,872 votes.

The petition was initially lodged by Mr Robert Kemei who withdrew and was substituted by Mr Kitur, who emerged second in the election.

Mr Kitur had vied in the election as an independent candidate.
