Lawyer Kethi Kilonzo whose registration as a voter has been questioned on allegations of fraud has gone to court seeking bail to pre-empt arrest.
The lawyer is being investigated over allegations that the voter registration slip she used to seek clearance to vie for the Makueni seat was stolen from the electoral commission.
She may be arrested if police find enough evidence to warrant her prosecution.
โWe filed an application for anticipatory bail this morning,โ lawyer Julie Soweto, who represented her during the proceedings regarding her registration status as a voter, told theย Nation.
Responding to an SMS enquiry, she wrote: โDirections were to be given at 4pm on how we are to proceed with the application but the file has not come back from the duty judge.โ
โWe have been asked to check tomorrow (Wednesday) morning,โ she said.
Ms Kilonzo rose to prominence during the Presidential election petition at the Supreme Court as the lawyer for Africog, a local NGO.
Ms Kilonzo, the daughter of former Makueni Senator Mutula Kilonzo, had been nominated by Wiper party to contest the by-election following her fatherโs death but was disqualified after her registration as a voter was questioned.
Her opponents had filed a complaint that she was not a registered voter hence not qualified to contest. The IEBC tribunal concluded that she was not a registered voter as her name was not in the voter register.
The commission, during the proceedings, had alleged that a registration slip that she produced as evidence of her registration had been plucked out of a booklet used to register only retired President Mwai Kibaki.-nation.co.ke
