Nairobi, Kenya: ICC prosecutor Fatou Bensouda Monday made an application to Trial Chamber V (b) requesting the judges to revert earlier decision to excuse President Uhuru Kenyatta from continuous presence in trial.
The prosecutor argued that the court erred in making this particular decision, saying that chambers have the discretion to reconsider decisions.
โChambers have discretion to reconsider their decisions when a decision is manifestly unsound and its consequences are manifestly unsatisfactory,25 or when new or previously unavailable information requires that the Chamber reconsider its previous ruling,โ said Bensouda.
The prosecutor also says that it would ensure equal treatment for both the president and his deputy William Ruto.
The decision allowing Ruto to skip some sessions of his trial was reverted following a successful appeal filed by the prosecution.-standardmedia
