NASA petition pegged on vagueness, misconceptions - IEBC

The August 8 General Election was free and fair, the Independent Electoral and Boundaries Commission (IEBC) has said.

IEBC says the National Super Alliance (NASA) petition challenging the declaration of Uhuru Kenyatta as the winner of the August 8 presidential election is coupled with vagueness and misconceptions, with the electoral agency affirming that it complied with the Constitution and all relevant electoral laws as pronounced by the courts.

IEBC further argues that the figures projected on its portal did not affect the results as claimed by NASA, attributing the delay in receipt of forms to their big file size and lack of steady 3G and 4G network in some parts of the country.

IEBC further countered NASA’s petition stating that all party agents were given equal opportunity to verify the results, denying reports that forms used to declare results were not authentic.

Chief Executive Officer, Ezra Chiloba, expressed satisfaction with the electoral process, with the Supreme Court Judges expected to start hearing the petition Saturday (August 26).

During the filing of its response at the Supreme Court on Thursday (August 24) night, IEBC said that it complied with the Constitution, all relevant electoral laws and the interpretation of the law as pronounced by the courts.

The electoral body further argued that statistics of results and images of forms were sent from polling stations simultaneously and that the declaration of presidential election results was on the basis of Forms 34B from all the 290 Constituency Tallying Centres and the Diaspora.

It further argues that the entire process was impartial, neutral, accurate, transparent and verifiable. And that all forms used to declare results were authentic and agents of parties were afforded an opportunity for verification.
