A three-judge bench is hearing a petition filed by Kethi Kilonzo challenging the electoral commission’s decision to block her from contesting the Makueni Senate seat.
High Court judges Weldon Korir, Mumbi Ngugi and Richard Mwongo will hear and determine the application against the IEBC dispute resolution committee.
Ms Kilonzo has sued the IEBC after its dispute tribunal stopped her from vying for the Makueni senate seat saying she was not a registered voter.
Two weeks ago, the IEBC dispute tribunal revoked Ms Kilonzo’s nomination despite her being cleared by the Makueni County returning officer.
Ms Kilonzo wants the tribunal’s decision set aside saying IEBC could not hear a case in which it was an interested party.
The case was before Justice Lenaola but he disqualified himself from hearing it and referred the matter to Dr Mutunga to appoint a three-judge bench to arbitrate on the matter.
The judge certified the case urgent and subsequently pushed the by-election from July 22 to July 26 to allow full hearing and determination of Ms Kilonzo’s petition.
Through her lawyer Julie Soweto, Ms Kethi also wants the Gazette Notice of the listed candidates of the mini-poll that was published on Monday, and which excluded her, suspended until the case is heard and determined.nation.co.ke
