Machakos Senator Johnstone Muthama has been allowed to sue the Inspector General of Police, David Kimaiyo, for contempt of court over his failure to provide him with security.
High Court judge Weldon Korir granted the orders yesterday. This happened after he was informed that the IG had not obeyed a court order. The order was to provide Muthama with state security. On November 19, High Court judge Mumbi Ngugi ordered Kimaiyo to give Muthama security. This was after the senator claimed that his life is in danger following withdrawal of his security detail.
Yesterday, lawyer John Khaminwa, for Muthama, informed Justice Korir that despite being served with the court order, Kimaiyo has declined to give the senator security.
The lawyer said the disobedience is in violation and contempt of the orders. Furthermore, the court cannot permit its orders to be disobeyed. The parties will report to the court on December 17 for further directions.
