Most people know only two routes to a US green card: the lottery, or finding an American company willing to sponsor you. Both are difficult. The lottery is largely luck, and finding a sponsoring employer costs that company upwards of $20,000 in legal fees alone. But EB2-NIW bypasses the employer requirement entirely, allowing highly skilled individuals to petition the US government directly for permanent residency.
To qualify, your case must satisfy three pillars or “prongs.” First, your work must have substantial merit and national importance. And this isn’t limited to STEM content creators, educators, healthcare workers, and community leaders can all qualify. Second, you must demonstrate that you’re positioned to advance that work within the United States. Third, the government must determine that waiving the job offer requirement is genuinely in America’s national interest.
It’s a rigorous process, but a legitimate and powerful one especially in today’s climate.
