Former Kangundo MP Charged with Defiling School Girl 15

A former legislator was on Monday arraigned in a Kangundo court for allegedly defiling a 15-year-old primary school girl. Immediate former Kangundo MP Moffat Maitha appeared before Senior Principal Magistrate Monica Nyakundi where he denied the charge.

He was charged alongside Ms Veronica Nthenya, who was accused of taking advantage of her closeness with the girl to facilitate her (minor’s) meeting with Maitha.

She, too, denied the charge.

Maitha is said to have committed the offence between June 10 and 23 at Kalandini village of Matungulu District. His lawyer P M Kuria made an application to be served with the medical report as well as the complaint forms, a plea the court granted.

The courtroom was filled to capacity as Maitha’s political supporters turned up in large numbers to follow the proceedings. The two were released on Sh200,000 cash bail each with a surety of a similar amount. Hearing date was fixed for October 2.

In Nyeri, a college student will serve 20 years behind bars for defiling a girl, 14. Sammy Mwangi Munyiri was accused of defiling the minor at Nairutia village on the night of January 6 and 7.  He also faced charges of indecent act with a child.

While delivering the sentence, Chief Magistrate Ms Wilbroda Juma said that prosecution proved beyond reasonable doubt. During hearing, the court declared the complainant hostile, after she defended Mwangi.

“The law treats the offence as serious and has set a minimum sentence probably to guard against persons who may prey on girls of that age,” Juma noted. The minor’s father said that his daughter went missing on January 6 and a search for her did not bear fruits until the following day.

He told the court that he was informed his daughter was seen in a lodging in Nairutia town, but did not find her. He said that later, he reunited with his daughter and they reported the matter at Nairutia Police Station.

The court heard that a doctor’s report indicated that her hymen was broken and there was blood in her bodily fluid.
