Ex-diplomat challenges Sh6.8m theft case in Zimbabwe

A court has postponed a case in which a Kenyan diplomat is accused of stealing Sh6.8 million. A court has postponed a case in which a Kenyan diplomat is accused of stealing Sh6.8 million after she claimed that her suit should be heard in Zimbabwe.

Ms Margaret Ayuma Katungu said the case, where she is accused of stealing the cash from the Kenyan embassy in Zimbabwe, relates to international law and should not be tried in Nairobi.

The prosecution sought more time to ascertain her claims.

“These are very weighty issues raised. I realise we need more time, at least two weeks to ascertain and respond and further determine on whether and where the suspect will be charged,” the prosecution said.

The accused’s lawyer Nzamba Kitonga had argued on Tuesday that Ms Ayuma, who served as a financial attaché at the embassy, should not be charged in Kenya as the alleged offences were committed in Harare, Zimbabwe.

Mr Kitonga said the Kenyan court cannot have jurisdiction to entertain charges or hear a case in relation to an offence committed outside the country unless the Director of Public Prosecution in Zimbabwe says so.

Principal Magistrate Peter Ndwiga ruled that Ms Ayuma takes her plea on February 5.-nation.co.ke
