Maraga apologises to Kenyans for failing to deliver full verdict

Chief Justice David Maraga has apologised for disappointing those who expected a full judgement for NASA’s presidential election petition.

“We had long hearings and some of them gone to late at night. I am sorry we have to disappoint those who expected a full judgement,” he said on Friday.

The Supreme Court judge said Kenyans should understand that given the timelines they can only summarise their ruling.

“Given the tonnes of materials placed before us it was not humanly possible to go through the judgments and write a reasoned and well considered judgement. If we don’t deliver a judgment today we will have a crisis,” he said.

NASA went to the Supreme Court to challenge the results of a presidential election, which it says was rigged.

The opposition wanted President Uhuru Kenyatta’s victory nullified.

According to the IEBC, Uhuru won the August 8 election by 1.4 million votes.

NASA wanted the judges to both read their judgements to hear what they had to say on the petition.

Four members of the seven-judge bench have ruled in favour of the petition while two – Njoki Ndung’u and Jackton Ojwang – have ruled against it.

Justice Mohamed Ibrahim was taken ill on Tuesday and was unable to attend hearings.
