Supreme Court affirms Evans Kidero’s election as Nairobi governor

The Supreme Court has affirmed the election of Evans Kidero as Nairobi governor, saying the petition by his competitor Ferdinand Waititu was filed out of time.

The court’s judges also said there was not enough evidence adduced in court to warrant the nullification of the election.

The Elections Act provides that an appeal arising from the decision of the High Court should be lodged within 30 days from the date of the judgment.

The lawyer representing Dr Kidero, Prof Tom Ojienda, had said during the submissions that Mr Waititu filed the appeal on November 22, 2013, more than two months after the High Court delivered its judgment.

It was also submitted that the Court of Appeal unlawfully reopened the case and shifted the burden of proof.
