Victimsโ€™ lawyer Fergal Gaynor wants ICC Chief Prosecutor Fatou Bensouda to lay bare her case against President Uhuru Kenyatta to correct โ€œmisinformationโ€ in public discourse.

In a new request to ICC judges, Gaynor said detailed allegations in the case referred to in legal parlance as a pre-trial brief should be made public.

โ€œThis would in turn contribute to ensuring public debate about this case is informed and accurate, which too often is not the case,โ€ he said.

Gaynor said details of the crimes against humanity charges would be key to the Assembly of State Parties should the judges decide to sanction Kenya for non-compliance.

โ€œIt is imperative that the state parties have a full and informed understanding of the allegations at the heart of this case, and the question of interference with witnesses,โ€ he said.

โ€œThis will assist them in making an informed decision as to what action they decide to take in an effort to secure the Kenyan governmentโ€™s full compliance.โ€

During a status conference on October 7, Bensouda said there is evidence Uhuru procured weapons and bankrolled the outlawed mungiki sect, who then went on a killing spree.
