Victimsโ lawyer Fergal Gaynor wants ICC Chief Prosecutor Fatou Bensouda to lay bare her case against President Uhuru Kenyatta to correct โmisinformationโ in public discourse.
In a new request to ICC judges, Gaynor said detailed allegations in the case referred to in legal parlance as a pre-trial brief should be made public.
โThis would in turn contribute to ensuring public debate about this case is informed and accurate, which too often is not the case,โ he said.
Gaynor said details of the crimes against humanity charges would be key to the Assembly of State Parties should the judges decide to sanction Kenya for non-compliance.
โIt is imperative that the state parties have a full and informed understanding of the allegations at the heart of this case, and the question of interference with witnesses,โ he said.
โThis will assist them in making an informed decision as to what action they decide to take in an effort to secure the Kenyan governmentโs full compliance.โ
During a status conference on October 7, Bensouda said there is evidence Uhuru procured weapons and bankrolled the outlawed mungiki sect, who then went on a killing spree.
