Former President Mwai Kibaki yesterday testified in a Nyeri court for the first time over a plot in Nyeri town he co-owns with five others.
Kibaki appeared before judge Anthony Ombwayo and was cross-examined for more than an hour.
He answered questions on how Mathingira Wholesalers Ltd was founded in 1970s.
However, Kibaki declined to answer when the plaintiffs’ lawyer Lucy Mwai asked whether his (Kibaki’s) brother Samuel Githinji sold some of the shares.
“I cannot speak on behalf of somebody who is alive and mature. He is here and will speak for himself,” Kibaki said.
The former President is named as one of the defendants in the suit filed by Mathingira Wholesalers Ltd.
Ndiritu Munuhe, Kanyi Waiganjo and Sammy Maina have claimed ownership of the property.
Kibaki said due to his duties as President, he could not attend any company meeting.
“I own many companies in this country but I left them to be run by trusted individuals. I can’t know the exact activities that happened,” he said.
Kibaki tabled several documents in court as evidence that the plot belongs to them.
He co-owns the plot with his brother Githinji, neighbours Kimwatu Kanyungu, Kiiru Gachinga, the late Gadson Gitonga and Kibera Gatu.
