Mr Waititu, Mr Joseph Ongete, Mr Peter Ochieng, Mr Philemon Oloo and Mr Naftal Ogolla are said to have started subdividing a property in Hurlingham, Nairobi, on December 5, 2011 so as to sell it.
The case will be mentioned in March.
