Reprieve for Alfred Mutua as Supreme Court suspends elections

Reprieve for Alfred Mutua as Supreme Court suspends electionsMachakos Governor Alfred Mutua was reprieved on Wednesday by the Supreme Court’s suspension of elections for the post.

The Court of Appeal nullified Mutua’s election on June 8 after his arch-rival Wavinya Ndeti appealed a High Court ruling that had upheld his August 8, 2017 elections win.

The Supreme Court issued stay orders that will remain until the matter is heard and determined.

“[This] conservatory order restrains the first respondent – IEBC – from announcing or conducting gubernatorial elections in Machakos,” the court aid.

The top court also issued orders preventing the Machakos Speaker from assuming the office of the Governor until the appeal is determined.

A motion for the Governor’s removal sailed through at the assembly.

While quashing Mutua’s win, judges said the results declared by the county returning officer failed the constitutional test of verification.

It was also said that the declaration of Mutua as winner had no legal basis.
