Three men have been sentenced to death for the January 2008 killing of former Embakasi MP Melitus Mugabe Were.
A woman, who was charged alongside the three, was, however, freed by High Court judge Luka Kimaru for lack of evidence.
The judge ruled that the prosecution had proved that James Omondi, Wycliffe Simiyu and Paul Otieno killed Mr Were on January 29, 2008.
โHaving analysed the evidence and the accused personโs decision not to ask for mercy, I sentence them to death as prescribed in law,โ the judge ruled.
Ms Mary Wamaitha escaped the death sentence after Justice Kimaru set her free, saying there was no evidence linking her to the murder of the former MP.
Mr Were was killed by gunmen in Woodley Estate, Nairobi, shortly after the 2007 general elections.
