Kenya defaced my passport to prevent my return, Miguna says

Lawyer Miguna Miguna has accused the government of defacing his passport to deny him his right to return to Kenya.

Immigration boss Gordon Kihalangwaย earlier surrendered Migunaโ€™s passport to court in compliance with Justice Luka Kimaruโ€™s directive.

The document is perforated, meaning the NRMKe Generalย will have to apply for a new one.

In a statement on Tuesday, Miguna said the government has disrespected the court and violated his constitutional rights.

“What the illegitimate government has done is to deposit a defaced passport in defiance of the court order.ย This must be seen in light of the respondentsโ€™ continued defiance of court orders.”

But he noted:ย “We must prove them wrong.ย The respondents believe, wrongly, that the guns they wield are far superior to the courts.ย The struggle against the purveyors of impunity and abuse of power will continue.”

The passport was issuedย on March 23 2009 and confiscated on February 6 after the lawyer was arrested for his roleย during Nasa leader Raila Odinga’s ‘swearing-in’ as the People’s President.

The perforated document has now been attached to the court file.

Kimaru said Miguna’s deportation was illegal but Interior CS Fred Matiang’i insisted he followed the law.

Miguna wants the state compelled to facilitate his return to Kenya.

  1. It is deplorable to see that Truth and Justice have become very relative in Kenya and particularly with the likes of Miguna Miguna. Whoever clamors for justice must himself be reasonable and trustworthy and not a harbinger of anarchy and animosity in our beloved land of Kenya. May I humbly submit that He who comes to equity must come with clean hands.
