Nairobi, Kenya: A guard working at Orchid Apartments has written to the Director of Public Prosecutions alleging Nairobi Woman Representative Rachael Shebesh assaulted him.
Kazungu Changawa, an employee of Watchdog Company, said he was assaulted by a person known to him as Rachel Shebesh.
The letter seeks the immediate appraisal of the status of investigations and later the prosecution to institute criminal proceedings against the assaulter.
Through Sagana, Biriq and company advocates, the letter claims that their client reported at Kileleshwa police station on July 17, last year.
โOur client was directed to be examined and a P3 form issued to him on July 22, which was forwarded to the OCS Kileleshwa police station,โ the advocates state in the letter.
Changawa said his efforts have been rendered futile and he has lost trust in the police and the Office of the Director of Public Prosecution (DPP) as no action has been taken since he lodged his complaint
. โThe main reasons for failure to take action could be the high socio-political position the accused is holding and is thereby stage managing the prosecutorโs office,โ states the letter signed by Innocent Muganda.
Public disturbance The legal firm said their client has continued to suffer prejudice, injustice and that further failure to institute prosecution amounts to breach of the law.
Muganda, on behalf of his client, has issued seven days notice to the DPP to take action, failure to which legal proceedings would be taken against the office.
This comes at a time when Nairobi Governor Evans Kidero and Shebesh are facing criminal charges of assault and public disturbance after they failed to settle their matter out of court.
Shebeshโs lawyer Cecil Miller said the woman MP is ready to be charged while Kideroโs lawyer Tom Ojienda said negotiations between both parties were still on.
