EACC Clears CS Kamau, Koskei, Chirchir of Corruption Allegations

There is insufficient evidence to pursue corruption allegations against cabinet secretaries Michael Kamau (Transport), Felix Koskei (Agriculture) and Davis Chirchir (Energy), the EACC has said.

The commission recommended the closure of their files alongside those of Nairobi Senator Mike Sonko and Narok Governor Samuel Tunai.

In a statement to newsrooms on Friday, DPP Keriako Tobiko said he had received the officials’ files as well as those of eight Makueni county officials including Alex Mutuku.

The EACC recommended that the Makueni officials be charged over the use of funds exceeding the county assembly’s approved budget.

Tobiko said decisions on the files will be made after an independent review.

The office of the DPP has received and acted on 28 files so far, Tobiko reported.

Of the 28, the DPP upheld the EACC’s recommendation to close 6 but ordered administrative action over one, and further investigations into another.

The number of files in which the DPP accepted the EACC’s recommendation for prosecution is 17, whereas one recommendation for charges was declined.

The DPP said the prosecution of 74 officials has been approved so far.

Sonko and Chirchir have been accused of corruptly asking for a kickback of Sh1.39 billion.

The EACC corruption report accuses Chirchir of being the perpetrator of corruption in procurement processes and the awarding of tenders at the ministry.

He is allegedly working to ensure the successful execution of corrupt deals in the energy sector.

“A case in point is where there was an attempt to influence the awarding of a Kenya Pipeline Company tender costing $500million (Sh46.2 billion) to SINOPEC instead of ZAKHEM,” read the report.

Kamau is alleged to have manipulated various road tender awards.

โ€œThese include the conflict of interest that involves a consultancy company that is associated with him, APEC Consulting,โ€ the report states.

Koskei is accused of sugar importation, land renting for potato planting and intimidating departmental heads of parastatals under his ministry for bribes.

Tunai faces allegations of irregular procurement, mismanagement of county revenue and nepotism.

All the five officials denied the allegations against them.
